SECTION 1. INTRODUCTION

1.1 These terms and conditions govern the installation and assembly service provided by XTERIOR LIFESTYLE LTD for products purchased through our website.

1.2 Products that include or offer assembly and installation services are subject to these terms and conditions. By placing an order for such items, you agree to these terms.

1.3 This document does not affect your statutory rights as a consumer, such as those under the Consumer Contracts (Information, Cancellation and Additional Charges) Regulations 2013 or the Consumer Rights Act 2015.

2. Interpretation

2.1 In these terms and conditions:

  • a) "We" means Xterior Lifestyle, trading as Xterior Lifestyle Ltd.
  • b) "You" means our customer or prospective customer. "Us", "our", and "your" should be construed accordingly.
  • c) Variations include additions, omissions, or substitutions to the originally agreed work, fittings, and fixings.

3. Quotations

3.1 All quotations for work are based on the information provided by you. Any variations to the work after issuing the quotation and before work commencement will result in a revised quotation for your acceptance.

3.2 For variations after work has started, a fixed price to cover the variation will be agreed upon and added to the final invoice.

3.3 If requirements change due to insufficient information, defects in existing installations, or extensive additional work, you will be liable for any additional expenses incurred.

4. Unforeseen Costs

4.1 You will be liable for the cost of any additional work, services, or fittings needed to address unexpected events or situations that arise during the work, which are beyond our control. We are not responsible for such events or situations.

4.2 It is your responsibility to ensure that:

  • a) Any necessary groundworks are completed before our team arrives.
  • b) You have accurately measured the site and have sufficient safe space for the assembly.

4.3 If our team arrives and is unable to carry out the assembly and installation because of non-compliance with 4.2(a), 4.2(b), 5.5, or 5.6, we reserve the right to charge for mileage and travel time for any additional journey or to deduct these costs from any refund if the order is canceled.

5. Liability

5.1 We are only liable for the work we carry out. No liability is accepted for defects in existing installations or parts not manufactured or supplied by us.

5.2 We are not responsible for loss or damage to property, materials, or injuries caused by your actions or those of household members or guests before, during, or after the work.

5.3 All advice provided by us is opinion only and accepted at your sole discretion and risk. You employ our services at your sole risk.

5.4 We will not be liable for any damage when anchoring pergolas to your decking, patio, garden, or property using ground bolts, anchors, or other devices.

5.5 It is your responsibility to ensure the ground surface is adequately prepared. Ideally, your surface needs to be level and capable of anchoring the pergola.

5.6 For pergolas erected on slabs or brick-paved patios, we recommend creating a concrete footing beneath each leg for anchoring. If you are satisfied with the safety of your surface, no further work is required.

5.7 XTERIOR LIFESTYLE LTD is not liable for damage to pergolas that have moved or suffered wind damage because they were not anchored appropriately.

5.8 If an issue arises within 14 days of installation, XTERIOR LIFESTYLE LTD will arrange a return visit to fix it. After this period, the installation is deemed complete, and a call-out charge will apply.

6. Health and Safety

6.1 We will take practical measures to ensure a safe working environment. You are expected to do the same. We accept no liability for actions by you or others that result in damage or injury outside of working hours.

6.2 We reserve the right to refuse work in unsafe environments, where works are deemed unsafe, illegal, or not compliant with Building Regulations, or where other parties are at risk.

6.3 If you notice any unsafe situation, property, equipment, or materials, you must inform us immediately.

6.4 If hazardous materials, such as asbestos, are discovered on site, we will notify you and may cease work until they are removed and disposed of per relevant legislation. The cost of removal and disposal is your responsibility.

7. Duty of Care

7.1 We accept a duty of care to you regarding materials, workmanship, security, property, and belongings, and will conduct our business with a reasonable level of care.

8. Building Regulations

8.1 We reserve the right to refuse work that breaches Building Regulations or is believed to breach these regulations or their intent.

9. Services and Waste

9.1 You will provide and pay for all power and water reasonably used by us during the work. You are also expected to provide access to sanitary facilities for us while we undertake the work.

9.2 We will remove any unwanted product packaging. Unless otherwise agreed, other waste removal and disposal are your responsibility and cost.
